The petitioner seeks bail in Patliputra P.S. Case No. 414/2017 registered under Sections 457 and 380 of the Indian Penal Code.
Some unknown miscreants are said to have entered into the house of the informant by breaking locks and looted cash, ornaments and mobile in the night.
It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. No incriminating article has been recovered from his conscious physical possession. One mobile and cash of Rs. 39,000/- have been recovered from the possession of the petitioner which belongs to him. There is no material in the record indicating the complicity of the petitioner in
Patna High Court Cr.Misc. No.26328 of 2018 (4) dt.24-05-2018 2/2 the occurrence barring the confessional statement of co-accused Sonu Kumar, which has no evidentiary value in the eye of law. Prior to the present case, the petitioner has been made accused in one more case, in which he is on bail. The petitioner has been languishing in custody since 07.12.2017 and co-accused Arbind Shinde @ Arbind @ Arbind Ashok Shinde has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 27.04.2018 passed in Cr. Misc. No. 19097/2018. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-cum-Sub Judge XII, Patna in connection with Patliputra P.S.
