The petitioners apprehend their arrest in connection with Harnaut P.S. Case No.538 of 2022, registered for the offences punishable under Sections 341, 342, 323, 379, 406, 420, 384, 504, 506 and 34 of the Indian Penal Code. The petitioners are said to have purchased potato from the informant and they did not pay the money to the informant. When the informant went to the house of the petitioners, the petitioners assaulted him.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. It is submitted that the petitioners have got no
Patna High Court CR. MISC. No.74230 of 2022(2) dt.04-02-2023 2/2 criminal antecedents as stated in paragraph-3 of the bail application.
Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioners by submitting that the injury reports of injured, Devendra Singh and Kali Charan support the prosecution case.
Taking into consideration the facts aforesaid and considering the nature of offence, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioners is hereby rejected. (Anjani Kumar Sharan, J) S.KUMAR/- U T
