Petitioner, already in custody, seeks bail in connection with Kotwali P.S. Case No.372 of 2017 registered under Sections 417, 418, 419, 465, 468, 469, 471 and 120(B) of the Indian Penal Code.

Allegation in brief is that in order to tarnish the image of Bihar School Examination Board, the petitioner and some other made viral the false question paper of Bihar School Examination Board on WhatsApp and on other social media. Learned counsel for the petitioner submits that except the confessional statement of the petitioner, there is no other material against him. It is further submitted that relating to the same transaction, four cases were instituted against the

Patna High Court Cr.Misc. No.26324 of 2018(4) dt.16-07-2018 2/2 petitioner and in those cases he is on bail and other co-accused Dhanraj Kumar and Karu Paswan have been admitted to bail by this Court vide order dated 08.03.2018 passed in Cr. Misc. No.13738 of 2018.

Having considered the aforesaid facts and circumstances, petitioner Prasenjeet Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Patna in connection with Kotwali P.S. Case No.372 of 2017.
