The petitioner seeks bail in Alipur P.S. Case No.14/2016, registered under Sections 386, 387, 388/34 of the Indian Penal Code and Section 17 C.L.A. Act.
Learned counsel for the petitioner submits that the petitioner was arrested on 04.02.2016 and since then he is in custody. The prayer for bail of the petitioner was earlier rejectred vide order dated 23.06.2017 with a direction to the trial court to conclude the trial within six months but more than a year has elapsed but trial has not been concluded. The petitioner is in jail for more than two years and four months. A report was called for from the A.C.J.M.-II, Gaya, who reported that only two prosecution witnesses have been examined as yet.

No.16887 of 2018 (3) dt.27-06-2018 2/2 Considering the aforesaid fact and the fact that the petitioner is in jail for more than two years and four months and the trial has not been concluded, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateII, Gaya, in Trial No.844/2017/1495/2017, arising out of Alipur P.S. Case No.14/2016.
