Petitioner apprehends arrest in connection with Bhabua P.S. Case No. 491 of 2019 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. There is no eye witness to the alleged occurrence. As a matter of fact, the informant was assaulted by some other persons who were unknown to him but due to previous enmity he has implicated the present petitioner. Learned Addl. Patna High Court CR. MISC. No.68818 of 2019(2) dt.27-11-2019 2/2 opposes the prayer for bail and submits that petitioner is named accuased and there is specific allegation of kidnapping the informant against this petitioner as also of assaulting alongwith other co-accused persons, which is supported by the injuries sustained.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
