2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 420 and 34 of the Indian Penal Code.
3. As per the prosecution case, on 20.07.2023 at 12 PM this petitioner and his family members began to demarcate the land of Shiv Temple and when the informant objected, they began to abuse the informant and started fighting and also threatened that if he comes again on their land it will not be safe.
4. It is submitted by learned counsel for the petitioner that the land in question stands recorded in R.S. Khatiyan in the name of Shyam Bihari Singh, who is grandfather of the petitioner, and also maternal grandfather of the informant with other co-sharers, out of which petitioner sold 30 decimal of
Patna High Court CR. MISC. No.75129 of 2023(2) dt.29-11-2023 2/2 land. The land in dispute are of the petitioner which he got from Khangi partition between his grandfather and other co-sharers. The current rent receipt of the year 2023-24 is also in the name of grandfather of the petitioner and also recorded in the Jamabandi Register. Due to this land dispute, false and concocted case has been lodged. Petitioner has got clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Chandi P.S. Case No.190 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
