The petitioner seeks bail in Narhat P.S. Case No. 10 of 2018 registered for the offence punishable under Section 412 of the Indian Penal Code.

Allegation against the petitioner is that he and four other co-accused were found sitting in a car which was parked near the looted car of informant Sudhir Singh whose car and belongings were looted by unknown criminals.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case on mere suspicion. Nothing has been recovered from his possession. It has been further submitted that except his confession there is no incriminating material against the

Similarly, situated co-accused persons have been granted bail by coordinate benches of this Court vide orders dated 22.05.2018 in Criminal Miscellaneous No. 31406 of 2018 and 24.05.2018 in Criminal Miscellaneous No. 31512 of 2018. Petitioner is in custody since 08.01.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Vth, Nawadah, in connection with Narhat P.S.
