JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-03-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable and u/s 25(1-b)a, 26, 35 of Arms Act. As per the prosecution case, on the disclosure made by co-accused, who were apprehended on the spot and from their possession arms and ammunition were recovered, petitioner has been made accused in this case. Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has transpired in this case during the course of investigation in the confessional statement of co-accused, Anshu Raj and Ritik Singh. No arms and ammunition has been recovered from the possession of the petitioner. Petitioner claims clean antecedent.

No.1458 of 2023(2) dt.27-03-2023 2/2 Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that during the course of investigation it has come that this petitioner and other accused persons were involved in the murder of Jitendra Kumar Sah.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
