The petitioner is languishing in custody in a case registered for the offences punishable under Sections 272, 273, 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibitions & Excise Amendment Act 2022.

There is recovery of 600 ml of country made liquor from the possession of the petitioner and 3.330 litres of illicit liquor from the motorcycle. It is submitted by learned counsel for the

Patna High Court CR. MISC. No.1054 of 2023(3) dt.03-04-2023 2/2 petitioner that petitioner is innocent and he has falsely been implicated in this case. Nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner has no concern either with the seized motorcycle or the illicit liquor. The petitioner is languishing in custody since 04.10.2022.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No. 2, East Champaran, Motihari in connection with Ramgarhwa P.S. Case No. 341 of 2022.
