Learned counsel for the petitioner submits that the petitioner is the purchaser of land, which was subject to acquisition to sale deeds no. 3396, 3397, 3398, 3399 and 3400 on 18.05.1992, total area 50 decimal situated at VillageBishambarpur, P.S.- Bihta, Thana No. 57, Circle- Bihata and District-Patna and thereafter coming continuously in the possession of the said land which is subject matter of the acquisition.

3. Learned Counsel for the petitioner submits that one Satya Narayan Singh was granted relief who is purchaser of

Patna High Court CWJC No.820 of 2023 dt.17-08-2023 2/2 the said land of same Khata and same Plot from the same vendor on 03.01.1997 and his relief was granted but petitioner's representation was kept pending before the Land Acquisition Officer since long. Counsel further submits in paragraph-7 of the petition, it has been categorically pleaded that application dated 09.12.2019 and 15.04.2021 are pending before the Land Acquisition Officer, Patna on which no order has been passed as yet.

In this background, the petitioner is directed to file a fresh representation within four weeks from today and the Land Acquisition Officer, Patna is directed to pass order within six weeks thereafter, on the claim of the petitioner considering the case of Satya Narayan Singh also, as mentioned in the counter affidavit by the counsel for the State.

5. With the aforesaid direction and observation, the present writ petition is disposed off.
