JUSTICE NANI TAGIA ORAL ORDER 22-04-2025 This contempt petition has been filed alleging violation of order dated 29.08.2018, passed in C.W.J.C. No. 13139 of 2018, wherein the petitioner was directed to file a representation before the authority concerned and on such representation being filed, the same was directed to be considered and disposed of after conclusion of inquiry proceeding.

2. Opposite party nos. 1, 2 and 3 have filed a show cause, wherein in paragraph no.9, it has been stated as under:- "9. That the petitioner in compliance order dated 29/8//2018 passed in the instant writ

Patna High Court MJC No.4297 of 2019(2) dt.22-04-2025 2/2 petition filed his representation on 20/3/2019. The departmental proceeding was concluded on 3/9/2019, therefore the answering opposite parties considered the application of the petitioner and passed a detail reasoned order vide memo no. 3267 dated 20/9/2019. The claim of the petitioner was rejected due to a departmental proceedings, the petitioner was under suspension from 16/1/2007 and again from 21/4/2011 to the date of retirement on 31/10/2017, the petitioner was continuously under suspension and thus he has not completed 30 years of regular service and do not qualify for this benefit of ACP or MACP."

3. On perusal of paragraph no.9 of the show cause filed by opposite party nos. 1, 2 and 3, I find that the order dated 29.08.2018, passed in C.W.J.C. No. 13139 of 2018 has been complied with by the respondents.

4. In view of the above, the present contempt petition stands closed and disposed off.
