The petitioner seeks regular bail in connection with Fatehpur P.S. Case No. 119 of 2019 for the offence punishable under Sections 114, 302, 120(B)/34 of the Indian Penal Code. The allegation is regarding the husband (son of the petitioner) of the deceased victim lady having killed the deceased victim lady on account of non-fulfillment of demand for dowry. It is further alleged that the other accused persons including the petitioner herein used to instigate the husband of the deceased victim lady to demand dowry and they used to torture her for dowry.

The learned counsel for the petitioner submits that the petitioner is aged about 72 years, is an old person, he was living

Patna High Court CR. MISC. No.66772 of 2019(2) dt.10-01-2020 2/2 separately from his son and his deceased daughter-in-law, hence, there is no complicity of the petitioner in the alleged occurrence. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 13.07.2019. It is also submitted that the son of the petitioner i.e. the husband of the deceased victim lady is in custody.

Having regard to the facts and circumstances of the case, considering the submission made by the learned counsel for the petitioner as also considering the fact that the husband of the deceased victim lady, who is main accused, is behind the bars, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-X, Gaya in connection with Fatehpur P.S. Case No. 119 of 2019.
