The petitioner is in custody since 10.07.2019 in connection with Kotwa P.S. Case No. 169/2019 registered for the offence punishable under Sections 30(a),35 and 38 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner, but have been saddled on his shoulders as he was sitting in the cabin. It is further submitted that the petitioner is merely a Khalasi of the vehicle in question and has no criminal antecedents.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand)

Patna High Court CR. MISC. No.66623 of 2019(2) dt.24-10-2019 2/2 with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, IX cum Special Judge, Excise, East Champaran, Motihari, in connection with Kotwa P.S. Case No. 169/2019.
