The petitioner apprehends his arrest in connection with Hathua P.S. Case No. 195 of 2017 registered under Sections 341, 323, 506, 509, 354(B)/34 of the Indian Penal Code and section 12 of the POCSO Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. There is no specific allegation against the petitioner. Further submission is that during the course of trial, the victim girl has been examined (Anneuxre-3) and in her deposition, she has not supported the prosecution case nor named the petitioner. She further stated

Patna High Court CR. MISC. No.66458 of 2019(3) dt.17-12-2019 2/2 that accused persons have done nothing with her. Further submission is that petitioner has no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District JudgeI, Gopalganj in connection with Hathua P.S. Case No. 195 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
