JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 This is an application for grant of anticipatory bail in connection with Chandradeep P. S. Case No. 46 of 2019, disclosing offences under Sections 341, 323, 307, 379, 504, 34 of IPC.
As per F.I.R. four accused persons including the petitioner have assaulted the wife of the informant, causing injury. There is also allegation of snatching of golden chain against the petitioner. It further appears that petitioner has criminal antecedent and he is accused in two other cases. Submission of the learned counsel for the petitioner is that there is case and counter case between the parties. Moreover, injuries are simple in nature, except one injury and there is no specific allegation against him. It has further been submitted that petitioner is elected representative and the

Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, who has opposed the prayer for anticipatory bail on the ground that the wife of the informant was referred to PMCH and she was under treatment there also. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. Jamui, in connection with Chandradeep P. S. Case No. 46 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
