2. The petitioner seeks bail in connection with Runni Saidpur P.S. Case No. 254 of 2024 registered for the offence under Sections 341, 323, 376, 504 and 34 of the I.P.C.

3. The petitioner is named in the F.I.R. and is in custody since 12.08.2025.

4. The allegation against the petitioner is to commit rape upon informant on false pretext of marriage.

5. Learned counsel appearing on behalf of the petitioner submitted that the informant was major at the time of occurrence and the present implication raised when for any of the reason by the time of lodging of FIR the marriage could not

The informant was said to be in a live-in-relation for long one year before lodging of this FIR with petitioner. It is submitted that subsequently after lodging of FIR the marriage of the informant was solemnized with petitioner. While concluding the argument, it is submitted that petitioner is a man of clean antecedent.

6. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as allegation of rape raised in the background of false promise of marriage coupled with the fact that subsequently prima-facie it appears that informant solemnized marriage with petitioner, coupled with fact that petitioner remains in custody since 12.08.2025, accordingly petitioner above named, is directed to be released on bail in connection with Runni Saidpur P.S. Case No. 254 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned JM 1st Class, Sitamarhi /concerned court, subject to the conditions as mentioned under Section 437(3) of
