The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420 and other allied sections of the Indian Penal Code. As per the prosecution case, informant got opened three fixed deposit accounts in the bank in which petitioner was working as Cashier, but subsequently, when he made attemp to withdraw his amount, it was found that forged fixed deposit receipts had been given to him.

It is submitted that in the Internal enquiry of the bank, it was found that one Bindhyachal Yadav who was working as Guard in the concerned bank had committed forgery with the

The aforesaid fact is corroborated by the statement of informant, who stated before the inquiry officer of the concerned bank that he had given money to Bindhyachal Yadav and later on, Bindhyachal Yadav had given fixed deposit receipts to him. Petitioner is Cashier of the bank. Similarly situated co-accused Shankar Pandey has been granted bail by this Court vide order dated 27.02.2015 passed in Cr. Misc. No. 7566 of 2015 (Annexure-2). Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.

10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj P.S. Case No. 431 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
