The petitioner, who is in custody, seeks bail in connection with Chandi P.S. Case No. 97 of 2018 registered for the offence punishable under Section 7 of the Essential Commodities Act, 1955.

Informant in her written complaint has alleged that she received a confidential information that Blue Kerosene Oil Storage has been found in the house of one Naresh Singh. On receiving such information, she alongwith other police personnel raided the house of Naresh Singh, where she got 1470 litre illegal Blue kerosene oil storage in the house of Naresh Singh and petitioner was living there on rent.

Patna High Court Cr.Misc. No.42143 of 2018(3) dt.11-09-2018 2/2 It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. It has been further submitted that petitioner alongwith other persons were taking wine for which police raided and they were arrested in the house of Naresh Singh and petitioner was living there on rent. It has been further submitted that petitioner is neither P.D.S. dealer nor he has any concern of the said recovered Blue K. oil. He has been arrested merely on suspicion.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Hilsa, Nalanda, in connection with Chandi P.S. Case No. 97 of 2018.
