Petitioner apprehends his arrest in a case registered under Sections 147, 149, 341, 323, 379, 307 and 504 of the Indian Penal Code.

Informant has alleged in his written complaint that on 10.05.2019 at about 11:00 PM petitioner and other coaccused assaulted his brother Dinesh Sah who took their oxen after untying them and same was objected by his brother and on his raising alarm Mahesh Sah went to rescue him then it is alleged that accused also assaulted him.

It has been submitted on behalf of petitioner that he is innocent and has been falsely implicated in this case. The present case is a counter blast of case instituted by wife of

Patna High Court CR. MISC. No.72761 of 2019(2) dt.22-01-2020 2/2 brother of petitioner in which petitioner's side suffered injuries. It has been further submitted that petitioner is 16 years old and is 60% handicapped, as such allegations made against him are false and concocted. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Laxmipur (Gidhour) P.S. Case No. 177 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
