The petitioner is in custody since 01.09.2017 in connection with Khagaria P.S. Case No. 552 of 2017, G.R. No. 2346 of 2017 for the offence registered under Section 379 and 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that he was arrested along with stolen motorcycle in connection with Pasraha P.S. Case No. 105 of 2017 and, thereafter, he has been granted bail by the court below in connection with the said case. Learned counsel for the petitioner further submits that for the same motorcycle present case was registered, wherein, Khagaria P.S. Case NO. 552 of 2017, now he has been remanded in connection with the present case and languishing in

Patna High Court Cr.Misc. No.44989 of 2018(3) dt.14-08-2018 2/2 custody.

Considering the fact of the learned counsel for the petitioner that save and except these two cases there is no other case against the petitioner and that in connection with the earlier case, he has already been granted bail and the present case is also registered for the same offence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Khagaria, in connection with Khagaria P.S. Case No. 552 of 201, G.R. No. 2346 of 2017.
