JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Rupauli P.S. Case No. 68 of 2019, corresponding to G.R. No. 2027 of 2019, registered for the offence punishable under Section 393 of the Indian Penal Code. As per FIR while informant was going on motorcycle, two persons came on a motorcycle and tried to snatch the key of motorcycle and on alarm they assaulted him by lathi and danda. It is also alleged that when villagers assembled there they tried to flee away and one co-accused was apprehended who disclosed the name of the petitioner.

Submission of learned counsel for the petitioner is that except disclosure made by co-accused there is nothing against him and he is a student and his examination is going to be held in near future.

Patna High Court CR. MISC. No.67246 of 2019(3) dt.09-01-2020 2/2 Heard learned APP, who has opposed the prayer for anticipatory bail stating that in such cases appearance of accused persons is necessary for conducting TIP, as such he does not deserve anticipatory bail.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He has to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

Accordingly, this application is dismissed.
