1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 365, 34 of the Indian Penal Code and subsequently Sections 302, 201 and 120(B) of the Indian Penal Code has been added.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on 01.11.2022 in the night, 10 accused came at the house of the informant and started assaulting her father-in-law. It is next alleged that co-accused Baby Devi, who is sister-inlaw (Gotni) of the informant along with others have kidnapped
Patna High Court CR. MISC. No.73358 of 2025(2) dt.13-11-2025 2/3 her son namely Gurudev Yadav.
4. Learned counsel for the petitioners submits that in sum and substance what the informant alleges is that her son was kidnapped by her own Aunt. It is next submitted that during the course of investigation, the dead body of Gurudev was found near bank of a river, as such during the course of investigation the persons related with Baby Devi came to be implicated. It is next submitted that Gautam Yadav along with two others had approached this Court seeking anticipatory bail by filing Cr. Misc. No.81126/2023 and the same came to be allowed by an order dated 07.03.2024 passed by a learned Coordinate Bench (Annexure-2). It is further submitted that Baby Devi had also approached this Court seeking regular bail by filing Cr. Misc. No. 40210/2023 and the same was allowed by an order dated 11.08.2023 passed by a learned Coordinate Bench. It is further submitted that petitioners are also related to Baby Devi as has been specifically pleaded at para-9 of the anticipatory bail application.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the
Patna High Court CR. MISC. No.73358 of 2025(2) dt.13-11-2025 3/3 event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Rajoun P.S. Case No.500/2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
