JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

No doubt, in huge quantity liquor was recovered but according to the prosecution case itself, the aforesaid recovery was made from a field. Although, prosecution claims that the aforesaid recovery was made on the basis of the disclosure made by petitioner and other co-accused but submission on behalf of the petitioner is that the aforesaid claim of prosecution is concocted and, moreover, petitioner does not have any criminal antecedents and is languishing in jail custody since 27.8.2019.

No.66366 of 2019(2) dt.22-10-2019 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II - cum - Special Judge, Excise, Begusarai, in connection with Excise Complaint Case No. 150 C-2 of 2019.
