2. Earlier, vide order dated 25.04.2024 passed in Cr. Misc. No. 9138 of 2024, the prayer for grant of bail to the petitioner was rejected. This is the second attempt of the petitioner for grant of bail.

3. The petitioner seeks bail in connection with S.T. No. 202 of 2024 arising out of Fulkaha P.S. Case No. 134 of 2023 instituted for the offences under Sections 363, 365 of the Indian Penal Code.

4. The allegation against the petitioner is of abducting the daughter of the informant. It is further alleged that the petitioner has also committed rape upon the victim girl.

5. Learned counsel for the petitioner submitted that

No.79402 of 2024(3) dt.18-12-2024 2/2 first prayer for grant of bail to the petitioner was rejected on 25.04.2024 with the observation to the learned Trial Court to expedite the trial. Learned counsel further submitted that trial is still pending and the prayer for grant of bail to the petitioner may be reconsidered. Learned counsel further submitted that petitioner is in custody since 04.10.2023 and has one criminal antecedents.

6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

7. As per the report dated 16.11.2024 sent by the learned Trial Court regarding the stage of the trial, the case is pending for argument.

8. Considering the aforesaid facts and circumstances of the case and stage of the trial in the court below, now at this juncture, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for grant of bail is rejected.
