2. Petitioner seeks regular bail in connection with Amnour P.S. Case No. 208 of 2025 in a case registered for the offences punishable under Sections 103(1), 61(2), 3(5) of the B.N.S. Act.
3. As per prosecution story, petitioner alongwith other co-accused persons called deceased Shabnam Khatoon at her rented premises and committed sexual assault and murder by pressing her neck and subsequently hanged her by tree.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and has falsely been implicated in this case. He further submits that as per F.I.R. the daughter of the informant suddenly disappeared from house on 07.07.2025 at 8:30 p.m. and during search she remained traceless and only

He further submits that informant is not the eye witness of the alleged occurrence and she has not disclosed the source of information as to how she came to know that this petitioner committed the offence. As per postmortem report no external injury was found on the body of the deceased and doctor has opined cause of death asphyxia due to hanging. It is further submitted that after investigation police has submitted charge sheet under Section 108 of B.N.S. Petitioner is in custody since 08.07.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saran at Chapra, in connection with Amnour P.S. Case No.208 of 2025.
