Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 17.10.2017 passed in Cr. Misc. No.44977 of 2017 and the allegation is under Section 376 (G) of the IPC as well as under the POCSO Act. Submission of the learned counsel for the petitioner is that not a single witness has been examined and he is in custody for about 20 months.
Heard learned A.P.P. also and from perusal of the report, it appears that the case is pending only for examination of two unofficial witnesses and three Medical Officer and I.O.. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to
Patna High Court Cr.Misc. No.50569 of 2018 (3) dt.12-09-2018 2/2 the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it as soon as possible and at the time the S.P. is directed that the witnesses are produce in the court on regular basis so that the trial may be concluded within the reasonable period.
With the aforesaid observation, this application is dismissed.
