====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 14-11-2019 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek bail in a case for the offence registered under Sections 419, 420, 406, 467, 468, 471 and 120(B) of the IPC.

The prosecution story, in brief, is that the petitioners and others were the member of a gang who gave assurance to several candidates to provide employment in Railway and as such they organized a camp at Durgawati and the Medical Board

Patna High Court CR. MISC. No.66841 of 2019(2) dt.14-11-2019 2/3 for selection process was organized by illegal way. The petitioners and others prepared forged document and cheated to innocent 200 candidates.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 13.08.2019. The petitioner no. 1 has got no criminal antecedent. The petitioners have falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners are said to have involved in providing job in the Railways. The petitioners deny the allegation made in the F.I.R. They have got no concern with such appointment in the Railways. Whatever recovery is said to have been made from the petitioners, the same belongs to the petitioners. No incriminating article was said to be found there. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Kaimur (Bhabua), in connection with Durgawati P.S. Case No.
