JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 Earlier prayer for bail of the petitioner was rejected twice by this Court vide order dated 4.4.2017 in Cr.Misc.No. 10566 of 2017 and vide order dated 7.2.2018 in Cr.Misc.No. 56756 of 2017 and there is allegation of kidnapping of daughter of the informant.
Submission of learned counsel for the petitioner is that he has been made accused only on the basis of suspicion and till date only four witnesses have been examined in this case and the case is pending for examination of two more witnesses and petitioner is in custody for more than two years. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail
Patna High Court Cr.Misc. No.63327 of 2018(4) dt.02-01-2019 2/2 on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I-cum-Special Judge, POCSO Act, Lakhisarai, in connection with Barhaiya P.S.Case No. 57 of 2016, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and petitioner has to co-operate in disposal of trial and appear before the court as and when required, otherwise his bail bond shall be cancelled.
