Petitioner seeks bail in Mushahari P.S. Case No.75 of 2018 instituted for the offence under Section(s) 302, 376 Indian Penal Code and Sections 4, 6, 8, 10 and 17 of the POCSO Act.
Counsel for the petitioner submits that petitioner is not named in the First Information Report.
In the written report, it is alleged that nine years old daughter of the informant had gone to watch TV in the house of the petitioner and she did not return. In the morning at 6.00 hrs, the informant heard noise that dead body of his daughter is lying in the filed of Tribhuwan Sahani.
Patna High Court Cr.Misc. No.57536 of 2018 (3) dt.01-11-2018 2/2 Counsel for the petitioner submits that petitioner is not named in the First Information Report. He has been arrested merely on suspicion. As per written report itself, dead body has been recovered from the field of Tribhuwan Sahani. Petitioner is in custody since 23.04.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, POCSO Act, Muzaffarpur, in connection with Mushahari P.S. Case No.75 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
