Learned counsel for the petitioner submits that the present M.J.C application has been filed for restoration of Civil Writ Jurisdiction Case No. 6653 of 2023 to its original file which was dismissed for default on 09.08.2023 due to noncompliance of the order dated 26.07.2023. Counsel submits that vide order dated 26.07.2023, two weeks' time was granted to remove the defects as pointed out by the office, but the said

Patna High Court MJC No.3757 of 2024(3) dt.30-08-2025 2/2 defects could not be removed within the time prescribed. Counsel submits that it is an inadvertent mistake and in future, such mistake shall not take place and he is ready to deposit a sum of Rs.500/- (Rupees Five Hundred) before the Advocates' Association, Patna High Court.

In this view of the matter and considering the grounds mentioned in application, the present Miscellaneous Jurisdiction Case No.3757 of 2024 is hereby allowed and let, Civil Writ Jurisdiction Case No.6653 of 2023 be restored to its original file subject to payment of Rs. 500/- (Rupees Five Hundred) by the counsel for the petitioner before the Advocates' Association, Patna High Court.
