JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-12-2019 This application, for grant of anticipatory bail, arises out of Thawe P.S. Case No. 88 of 2018, disclosing offences under Section 366A and 34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant .

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and the real fact is that she has gone with one Abhimanyu Kumar and performed marriage with him and residing with him in Surat. In support of his contention, he has file a supplementary affidavit stating therein that there was some dispute between Abhimanyu Kumar and alleged victim girl Khusboo Kumari in Surat, for which, Abhimanyu Kumar has lodged a complaint under Section 97 of the Cr.P.C. against the alleged victim girl Khusboo Kumari and

Patna High Court CR. MISC. No.75949 of 2019(3) dt.13-12-2019 2/2 one Raju Kumawat giving their complete address, in which, notice has been issued by Additional Civil Judge, Surat Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Thawe P.S. Case No. 88 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure with further subject to the condition that petitioner shall cooperate with the police in tracing out the girl.
