Petitioner, who is in custody, seeks bail in connection with Harpur P.S. Case No. 44 of 2015 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Informant who is the wife of the deceased has stated that on 05.11.2018 her husband has gone to his tenancy field and slept in his hut and on the next morning i.e. on 06.11.2015 at about 5:00 A.M. when she went there she found her husband in pool of blood and his neck was slit. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case due to ulterior motives. Name of

No.58577 of 2018(3) dt.25-10-2018 2/2 petitioner has surfaced in this case on the basis of confessional statement of co-accused Amarendra Mandal and except that confession there is no any incriminating material against the petitioner. He has no criminal antecedent. He is in custody since 22.07.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Munger in connection with Harpur P.S. Case No. 44 of 2015.
