JUSTICE SANJAY PRIYA ORAL ORDER 29-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Sasaram Town (M) P.S. Case No. 1245/2017, instituted for the offences under Sections 366A/ 34 of the Indian Penal Code.

It is alleged in the written report that at 11 P.M. in night the informant found that main door of his house is opened and his daughter Saloni Kumari was not present in the house. The search was made in village then co-villager Rishimuni disclosed that his daughter was seen with Raj Kumar Chaudhary (Petitioner) and Sukar Chaudhary at Sasaram Railway Station. Learned counsel for the petitioner has submitted that from the written report itself, it appears that victim girl had

Statement of the victim girl has been recorded under Section 164 Cr.P.C. wherein she has stated that she was taken by this petitioner. She has not levelled any allegation of specific over act against this petitioner. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sasaram (Rohtas) in connection with Sasaram Town (M) P.S.
