JUSTICE SATYAVRAT VERMA ORAL ORDER 17-01-2025 Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the informant.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 504, 506, 120(B)/34 of the IPC and 27 of the Arms Act in connection with Deep Nagar P.S. Case No.40 of 2024.
3. The learned counsel for the petitioner submits that the petitioner has antecedent of one case and is in custody since 18.06.2024.
4. It is further submitted Sarswati Devi has moved this Court seeking anticipatory bail by filing Cr. Misc. No.44515 of 2024 and the same was allowed by an order dated 26.06.2024. It is next submitted that while considering the
Patna High Court CR. MISC. No.78959 of 2024(2) dt.17-01-2025 2/2 prayer for anticipatory bail of Sarswati Devi the case was considered on merit and in detail and from perusal of the order dated 26.06.2024 in Cr. Misc. No.44515 of 2024, it would manifest that specific allegation of firing was against Ravindra Yadav causing injury to the father of the informant who subsequently died and against this petitioner it is alleged that he was also involved in the conspiracy.
5. The learned APP and the learned counsel appearing on behalf of the informant opposes the bail application.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned VIIth Additional District and Sessions Judge, Nalanda at Biharsharif in connection with Deep Nagar P.S. Case No.40 of 2024.
7. The application stands allowed.
