The petitioner seeks bail in a case registered for the offence punishable under Sections 25 (1-b)a, 26/35 of the Arms Act. The prosecution case in brief is that on the basis of information furnished by the petitioner about manufacturing, sale and concealment of firearms by Deen Bandhu Bind the police conducted a raid and recovered one country made gun and three country made Katta from the open fodder house having no door planks, of Deen Bandhu Bind who expressed his ignorance abut the recovered arms and alleged plantation by some one other and then petitioner admitted the arms to have been kept by him in conspiracy with co-accused Pyare Bind having inimical terms with Deen Bandhu Bind and other co-accused.

Learned counsel for the petitioner submits that there is no

No. 66565 of 2019(2) dt.05-11-2019 2/2 recovery from the conscious possession or house of the petitioner rather the recovery was made from the house of Dinbandhu Bind It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.08.2019 and has got one criminal antecedent in Chainpur P.S. Case No. 234 of 2016 u/s 341, 323, 307, 379, 504,34 of the I.P.C., which was lodged due to land dispute, in which petitioner has been granted anticipatory bail by this Hon'ble Court. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Kaimur at Bhabhua, in connection with Chainpur P.S. Case No. 327 of 2019, G.R. No. 1870 of 2019.
