This is an application for grant of anticipatory bail in connection with Bhabua P.S. Case No. 334 of 2019, GR No. 1301 of 2019 registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

The allegation is regarding the accused persons having killed the deceased victim lady on account of non-fulfillment of the demand for dowry.

The learned counsel for the petitioners has submitted that the petitioner no. 1 is the brother-in-law of the deceased victim lady and the petitioner no. 2 is the wife of the petitioner no. 1. It

No.66362 of 2019(3) dt.05-12-2019 2/2 is further submitted that the petitioners do not have anything to do with the alleged occurrence and the fact is that the husband of the deceased victim lady is in custody, hence, no prejudice would be caused to the case of the prosecution. It is further submitted that the petitioners are having a clean antecedent. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabua in connection with Bhabua P.S. Case No. 334 of 2019, Gr. No. 1301 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
