JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-02-2020 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Chainpur P.S. Case No. 143 of 2019, registered under Section 304(B)/34 of the Indian Penal Code.

The accusation is that marriage of Lachi Devi, sister of informant, Ajay Bind, was performed before seven years with the petitioner. While she was kept properly at her matrimonial house for few years but thereafter, she was being tortured by her in-laws due to non-fulfillment of the dowry demand of she-buffalo and gold chain. Before ten days, brother-in-law of his sister informed that Sunil Bind (petitioner) has come from Gulf country and they will commit the murder of his sister. On next day in the evening, Sarvjeet Bind informed about the abdominal pain to his sister then he went there

Patna High Court CR. MISC. No.66787 of 2019(3) dt.24-02-2020 2/2 and saw the dead body of his sister at her matrimonial house and black spot was also seen on her neck but in spite of much protest, the dead body of his sister was cremated.

Learned counsel for the petitioner submits that admittedly, the marriage of the petitioner was performed with the deceased, sister of the informant, before seven years and the deceased, wife of the petitioner died due to abdominal pain but with ulterior motive, informant who is brother of the deceased has lodged the present case. Further submissions is that petitioner is in custody since 01.07.2019 and the charge sheet has already been submitted against him.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-II, Kaimur at Bhabua, in connection with Chainpur P.S. Case No. 143 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
