JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273 of the Indian Penal Code 30(a), 38(i) 41(i) of Bihar Prohibition and Excise Act 2016.

The alleged recovery has been made from a bush and the name of petitioner was disclosed by co-accused Raju Yadav, who was caught on the spot. Neither petitioner was caught on the spot nor anything was recovered from his conscious possession. Petitioner does not have criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.

Patna High Court CR. MISC. No.66407 of 2019(2) dt.22-10-2019 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge cum Special Judge, Excise, Siwan in connection with Siwan Muffasil P.S. Case No. 334 of 2018.
