Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 341, 376, 455, 504, 506 and 34 of the Indian Penal Code read with Sections 4 and 6 of the POCSO Act.

Learned counsel for the petitioner submits that petitioner has antecedent of two cases and has been falsely implicated in the instant case being father of Deepak Kumar. It is next submitted that Deepak Kumar had approached this Court seeking anticipatory bail by filing Cr. Misc No. 72305 of 2024 and the same came to be allowed by an order dated 22-3-2025.

Patna High Court CR. MISC. No.74801 of 2025(2) dt.07-11-2025 2/2 It is further submitted that Deepak and victim were in love as such they eloped. It is also submitted that FIR came to be instituted 16 days after the occurrence and the injury report does not corroborate rape.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner and also taking into consideration the fact that Deepak Kumar has been granted the privilege of anticipatory bail, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mahila P.S. Case No. 33 of 2024 subject to the conditions as laid down under Section 482 (2) of the BNSS. (Satyavrat Verma, J) Sumit/- U T
