Mr.Damodar Prasad Tiwary ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-11-2019 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Lalganj P.S. Case No. 224 of 2019 for the offences registered under Sections 363, 366/34 of the Indian Penal Code. The allegation in the present case is regarding kidnapping of the victim girl by one Jitendra Sahani and the other co-accused persons including the petitioners herein are said to have helped Jitendra Sahani in abducting the victim lady.

The learned counsel for the petitioners has submitted that if at all anyone is responsible for either abduction or even otherwise, of the victim lady, it is Jitendra Sahani and the

No.69296 of 2019(2) dt.16-11-2019 2/2 petitioners have got no role to play in the alleged incident inasmuch as the victim lady in her statement under Section 164 Cr.P.c. has not raised any sort of allegation of atrocities having been committed by the petitioners against her and it is only the co-accused Jitendra Sahani who is said to have kidnapped her and confined her at various places. The petitioners are stated to be having clean antecedent.

The learned counsel for the informant has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, the petitioners, above named, in the event of their arrest/surrender before the court below within a period of four weeks from today, are directed to the released on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 224 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
