Petitioner seeks bail in Triveniganj P.S. Case No.178/2015 registered for the offence punishable under Sections 384, 506 of the Indian Penal Code and Sections 66A, 66C and 66E of the I.T. Act.

Informant is M.L.A. of Legislative Assembly, who in her written complaint has alleged that she received message on her government mobile number for ransom of Rupees 5 Lakhs otherwise she was threatened to be killed. The mobile number is in the name of the petitioner and, as such, he has been made accused. It has been submitted on behalf of the petitioner that he was In-Charge Headmaster of the school at the relevant time and his mobile number was misused by persons inimical to him and the allegations are

It has been disclosed in paragraph no.3 of his petition that in the year 2015, petitioner has been made accused in 11 cases by his opponents because of the dispute for running the government school. He is in custody since 08.06.2018. Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, 1st Supaul in connection with Triveniganj P.S. Case No.178/2015, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
