Petitioner seeks bail in connection with Special Case No. 420 of 2019 arising out of Saharsa P.S. Case No. 793 of 2019 registered for the offence punishable under sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no concern with the seized article. Petitioner has no criminal antecedent. Petitioner is in custody since 04.09.2019.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.68728 of 2019(2) dt.06-11-2019 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II-cum-Special Judge, Excise, Saharsa in connection with Special (Excise) Case No. 420 of 2019 arising out of Saharsa P.S.
