JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-01-2020 This writ application has been filed seeking direction to the respondents to allow him the benefits of third Modified Assured Career Progression(MACP) and consequential revised pension.

The petitioner is said to have retired on 30.06.2017 while serving as a Driver in the Agriculture Department, Government of Bihar. According to him, he had completed 30 years of service on 10.02.2006 and he is accordingly entitled to third MACP with effect from 01.01.2009. It has been stated in paragraph 10 of the writ application that two persons, namely, Md. Samsad and Janardan Paswan, who were appointed on

Patna High Court CWJC No.21830 of 2019(2) dt.09-01-2020 2/2 19.09.1977, with the petitioner and who also retired while holding the post of Driver in the office of Directorate of Soil Conservation, Department of Agriculture, Government of Bihar, have been given benefits of third MACP by an office order dated 14.12.2018, issued by the Director, Soil Conservation of the Department.

Considering the averments made in the writ application, it is disposed of with a direction to the Director, Department of Agriculture, Government of Bihar (respondent No.4) to consider grant of third MACP to the petitioner and take a decision in this regard within two months from the date of receipt/production of a copy of this order.

This writ application stands disposed of.
