2. The petitioner has prayed for bail in connection with Town P.S. Case No. 191 of 2024 registered for the offence punishable under Sections 379, 420/34 of the Indian Penal Code and later on Section 409 of the IPC was added.
3. The case of the prosecution is that the informant, namely Radhika Devi, who is the Chairman of Mala Nari Shakti Mahila Swablambi Sahkari Samiti, and the Samiti has an account in the S.B.I., which is operated by the joint signature of the informant and the Board of Directors, but on 07.02.2023 some directors in connivance with the ex-C.E.O. Kunj Bihari
Patna High Court CR. MISC. No.75373 of 2025(2) dt.19-11-2025 2/3 (the petitioner) illegally withdrew a total of Rs. 1,87,000/-, and thereafter the informant locked the account, but the accused persons misused the letterhead of the informant and renewed the operation of the bank account and withdrew an amount of Rs. 3,33,000/-.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that the petitioner has received only maan-dey from that amount. Nothing has been withdrawn by him. It has also been submitted that the co-accused namely, Rita Devi , Durgawati Devi and Sugandha have been granted bail by learned Co-ordinate Bench in Cr. Misc. Nos. 37181 of 2025 and 73371 of 2025 respectively. The case of this petitioner stands on similar footing. He further submits that a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and is languishing in judicial custody since 27.08.2025.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is
Patna High Court CR. MISC. No.75373 of 2025(2) dt.19-11-2025 3/3 inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, Motihari in connection with Town P.S.
