JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-12-2018 Petitioner prays for bail in connection with Hajipur Town P.S.Case No. 114 of 2017 registered for the offence punishable under Section 382 of the Indian Penal Code. Allegation as per FIR is that while informant was going to his residence by rickshaw three miscreants, who were covered their face, came on a Scorpio vehicle and intercepted the informant and assaulted him by butt of pistol and they got seated the informant in the vehicle and went away. It is also alleged that miscreants also tried to commit loot of one Maruti vehicle but in the car several persons were sitting, so the miscreants did not succeed in looting the same and it further appears that petitioner is accused in six other cases. Patna High Court Cr.Misc. No.69201 of 2018(3) dt.13-12-2018 2/2 that so far this case is concerned, except confessional statement of co-accused there is nothing against him, nothing has been recovered from his possession, he has been remanded in several other cases and he is in custody since 28.12.2017. Further submission is that co-accused persons have been granted bail in Cr.Misc.No. 31889 of 2018 and Cr.Misc.No.41963 of 2018, vide orders dated 14.8.2018 and 9.8.2018 respectively. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P.S.Case No. 114 of 2017, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
