The petitioner seeks bail in a case registered under Sections 363, 366A/34 of the Indian Penal Code. The prosecution case in short is that the informant's minor daughter was kidnapped by the accused persons. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 05-05-2019. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. The victim has been rccovered. The victim was in love with one Ujjawal Kumar which is evident from the different letters, produced before the Sessions

Patna High Court CR. MISC. No.66859 of 2019(2) dt.22-10-2019 2/2 Court in course of argument. The petitioner has got no concern with the alleged occurrence.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 451 of 2019.
