The petitioner seeks bail in a case registered under Sections 457, 380, 411, 414 of the Indian Penal Code. Allegation is that unknown miscreants committed theft in the house of the informant and took away ornaments, clothes and cash Rs.10,000/-.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.05.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The petitioner is alleged to have been apprehended with stolen property. The said articles have not

Patna High Court CR. MISC. No.73482 of 2019(2) dt.19-11-2019 2/2 been put on T.I.P. to ascertain whether the same is stolen property or not. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in this case. The petitioner has not been put on T.I.P. to ascertain his participation in the alleged occurrence.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Gopalganj Town P.S. case No.251 of 2019.
