JUSTICE PURNENDU SINGH ORAL ORDER 19-04-2023 Heard Mr. Raju Kumar, learned counsel appearing on behalf of the petitioner; Mr. Anwar Karim, learned AC to GP-10 for the State and Mr. Arun Kumar Arun, learned counsel for the Accountant General.

2. Petitioner is the wife of the deceased employee who had retired on 31.01.2012 from the post of Panchayat Sevak. The deceased employee was being paid regular pension, however after his death, family pension has not been fixed and given to the petitioner in spite of the fact that the petitioner has fulfilled all the terms and conditions.

3. The District Magistrate, Muzaffarpur is directed to

Patna High Court CWJC No.287 of 2023(2) dt.19-04-2023 2/2 ensure sanction of family pension in favour of the petitioner and ensure payment by informing the Accountant General, Bihar along with duly sanctioned letter within a period of three weeks from the date of passing of this order. He must also ensure that all other retiral dues which are still pending to the deceased employee must also be paid within the aforesaid period including the difference of pension, difference of salary, revised pension and family pension.

The concerned respondents must consider the fact that the petitioner is a old illiterate pardanasheen lady and the authority must not harass her by calling her to discharge unnecessary formalities. If any documentation is required, the District Magistrate, Muzaffarpur must ensure to entrust a competent authority to visit the house of the petitioner so that the relevant documentation can be done within the aforesaid period.
