The petitioner seeks direction to the respondents to consider the case of the petitioner for grant of senior scale/ time bound promotion from the date of initial appointment and after completion of 12 years of service as Assistant Teacher on the Matric trained post in view of law laid down by this court in the case of Ram Ashis Tiwary & Ors v. the State of Bihar & Ors decided on 31.03.2011 which was affirmed by the division

Patna High Court CWJC No.21801 of 2019(2) dt.05-12-2019 2/2 bench in L.P.A. and the SLP preferred by the State of Bihar has also been dismissed.

Having considered the prayer made by the petitioner, I direct the District Programme Officer (Estb.), Patna, respondent No.6, to consider the case of the petitioner in the light of the judgement passed in the case of Ram Ashis Tiwary & Ors v. the State of Bihar & Ors within three months from the date of receipt of this order.

With the aforesaid direction, this writ petition is disposed of.
