====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR PANDEY ORAL ORDER 18-11-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners are apprehending their arrest in connection with Khusrupur P.S. Case No. 44/2025 registered for the offences punishable under Sections 191(2), 191(3), 190, 329(4), 324(5) and 326(g) of the B.N.S. and Section 27 of the Arms Act.

3. As per prosecution case, on 28.01.2025 the informant was taking meal in her house. In the meantime, she heard commotion coming from outside of her house, she saw the petitioners and others along with 20-30 unknown persons

Patna High Court CR. MISC. No.74518 of 2025(2) dt.18-11-2025 2/3 having armed with deadly weapons entered in the house of Lodhi Yadav @ Sakindar Yadav. The miscreants ransacked the house and damaged the movable and immovable properties by setting fire in the house. The miscreants also entered into the house of the other persons and damaged the movable and immovable properties/articles by setting fire in the house. When the informant and others protested, the miscreants resorted firing in the air and due to fear the informant and others came outside the house.

Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence as alleged in the FIR and they have falsely been implicated in this case due to village politics. The present case is nothing but the counter blast of earlier case filed by petitioners' side bearing Khusrupur P.S. Case No. 43/2025. There is allegation of setting the house on fire against the petitioners and others but the prosecution story does not reveal that as to who has set the house on fire and whose house has been set on fire and also what articles were burnt due to alleged occurrence. He further submits that there is no specific allegation against the petitioners, allegation are general and omnibus in nature. Petitioner nos. 3 and 4 bear no criminal antecedent and

5. The learned A.P.P. for the State opposed the prayer for anticipatory bail of the petitioners and submitted that the petitioners are FIR named accused persons and they cannot escape from the allegation made in the FIR.

Considering the facts and circumstances of the case, there is no specific allegation against the petitioners, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Patna City, Patna in connection with Khusrupur P.S. Case No. 44/2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
